Mobile Sawmilling and Woodworking

Mobile Bandsaw Milling – Terms & Conditions of Service

These Terms and Conditions (“Terms”) apply to all mobile milling services provided by Evolve Woodworks (“we”, “us”, “our”). By booking our services, the client (“you”, “your”) agrees to these Terms.

1. Booking & Quotes

1.1. All quotes are valid for 30 days unless otherwise stated.
1.2. A booking is confirmed once a date is agreed upon and any required deposit is paid.
1.3. Quotes are based on information you provide. If conditions on-site differ, additional charges may apply.

2. Client Responsibilities (On-Site Requirements)

To ensure safe, efficient milling, you agree to:

2.1 Log Preparation & Location

  • All logs must be placed together in one accessible location prior to arrival.
  • Logs must be free from excessive dirt, rocks, concrete, or debris to avoid equipment damage.

2.2 Site Access

  • Provide suitable access for a 14-metre truck and sawmill trailer.
  • Ensure all access routes (driveways, gates, paddocks, etc.) are sufficiently wide, clear, and safe for heavy vehicles.

2.3 Milling Area

  • Provide a reasonably flat, level and stable area for the milling setup.
  • If the ground is unsuitable, unsafe, or unstable, we may refuse to mill until rectified. Additional costs may apply if delays occur.

2.4 Steel & Foreign Objects in Logs

  • You must check or have logs checked for metal, such as nails, wire, screws, or fencing staples.
  • If our bandsaw blade strikes metal or other foreign objects inside a log, you will be charged the full replacement cost of the damaged blade, at our current blade price.

3. Service Area & Travel

3.1. Travel within our standard service area (as listed on our website/quote) is included.
3.2. Jobs outside this area incur a travel surcharge, calculated and agreed upon at time of booking.
3.3. Additional fees apply if we are delayed due to the site being inaccessible, unsuitable or waiting for logs to be relocated.

4. Nature of Timber & Product Expectations

4.1. Timber is a natural and variable product. Its appearance and performance are affected by:

  • Species, moisture content, age, and natural defects
  • Stress within the log
  • Grain variation, cracking, knots, rot, colour changes, insect damage, and internal tension

4.2. Because of these natural characteristics:

  • We cannot guarantee specific outcomes, dimensions, colours, grades, or recovery percentages.
  • We will mill to your instructions to the best of our ability, but results may vary depending on the condition of the logs.
    4.3. You acknowledge that issues such as warping, cracking, cupping, or movement after milling are natural processes and not a fault in our service.

5. Safety

5.1. Milling sites are restricted areas. For safety, you must keep all people, pets, and equipment clear of the work area at all times.
5.2. We may stop work if site conditions become unsafe. Costs may apply.

6. Payment Terms

6.1. Payment is required on completion of the job unless otherwise agreed in writing.
6.2. Late payments may attract fees or interest as permitted by law.
6.3. Additional charges (e.g., blade damage, extra milling hours, travel fees, standby time) will be added to the final invoice.

7. Cancellations & Rescheduling

7.1. Cancellations or rescheduling must be made at least 48 hours before the scheduled date.
7.2. Late cancellations may incur a fee to cover lost time and travel commitments.

8. Australian Consumer Law

Nothing in these Terms excludes or replaces your rights under the Australian Consumer Law (ACL).

  • You are entitled to services that are provided with due care and skill.
  • Where a major failure occurs, you may be entitled to a refund or compensation.
  • Where the issue is minor, we will work with you to remedy it within reason.

However, we are not responsible for:

  • Natural timber defects
  • Inaccurate or incomplete information provided by you
  • Damage caused by hidden steel or objects in logs
  • Issues arising from improper storage or handling of timber after we leave

9. Liability

We take all reasonable care when operating on your property. However, we are not liable for:

  • Damage caused by ground conditions, access tracks, or unstable terrain
  • Damage to underground services (unless clearly marked)
  • Damage caused by foreign objects inside logs
  • Loss of value or yield of timber due to natural defects

10. Acceptance of Terms

By booking our service, paying a deposit, or allowing us to begin work on-site, you confirm that you have read, understood, and agree to these Terms and Conditions.


Custom Woodworking Projects - Terms & Conditions
These Terms and Conditions apply to all custom woodworking products and services provided by Evolve Woodworks (“we”, “us”, “our”). By accepting a quote, paying a deposit, or engaging our services, you (“you”, “the client”) agree to the terms below.

1. Quotes & Scope of Work

1.1. All quotes are valid for 30 days, unless otherwise stated.
1.2. Quotes are based on the agreed scope of work, including design, dimensions, materials, and finishes.
1.3. Any changes requested after the quote is accepted (including size, design, materials, finish or additional features) may:

  • incur additional charges, and
  • extend estimated timelines.

1.4. No variations will be carried out without your approval.
1.5. All prices include GST unless otherwise stated.

2. Deposits, Payments & Cancellations

2.1. A 50% non-refundable deposit is required to secure your booking and allow us to purchase materials and commence work.
2.2. As custom work is made to your specifications, deposits cannot be refunded if you change your mind. This is permitted under the Australian Consumer Law (ACL) for custom items.
2.3. The remaining balance must be paid in full prior to collection or delivery.
2.4. We cannot release any items until full payment is received.
2.5. Payment methods: direct deposit/bank transfer or cash sale.
2.6. If you cancel after work has begun, you may be liable for additional labour or material costs incurred beyond the deposit amount.

3. Australian Consumer Law (ACL) Rights

3.1. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
3.2. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
3.3. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
3.4. These rights apply in addition to the terms set out in this document.

4. Natural Timber Characteristics (Important)

4.1. Timber is a natural product and will vary in grain, colour, texture, density, moisture content and appearance.
4.2. Natural characteristics—including knots, cracks, movement, grain variations, colour differences, sap lines, and minor imperfections—are normal and not considered defects.
4.3. Timber may move over time due to changes in humidity, temperature, or general environmental conditions.
4.4. By commissioning a custom timber piece, you acknowledge and accept these natural features and risks.
4.5. We take reasonable steps to select and prepare quality timber, but we cannot guarantee that timber will not move, cup, crack, or react to its environment.

5. Approvals, Photos & Updates

5.1. You will be provided with progress updates at key stages.
5.2. Approvals given at each stage (including photos, drawings or measurements) are final.
5.3. Requested changes after approval may incur extra costs and lead to delays.

6. Timeframes

6.1. Timeframes provided are estimates only.
6.2. Delays can occur due to timber curing, weather impacts, finishing times, material availability or workshop scheduling.
6.3. We will notify you promptly if significant delays occur.
6.4. We are not liable for delays outside our reasonable control.

7. Collection, Delivery & Risk

7.1. Completed items must be collected or delivered within 7 days of completion unless otherwise agreed.
7.2. Delivery and/or installation fees (if applicable) will be quoted separately.
7.3. Risk transfers to the client on collection or once delivery is completed.
7.4. We are not responsible for damage caused during client-arranged transport.
7.5. If collection is delayed beyond 7 days, a storage fee may apply.

8. Warranty & Aftercare

8.1. We provide a 12-month workmanship warranty, covering structural defects caused by our craftsmanship.
8.2. This warranty does not cover:

  • natural timber movement, cracking or warping
  • misuse, neglect, or improper care
  • exposure to weather or moisture (unless designed for outdoor use)
  • damage occurring after delivery or collection
    8.3. Care instructions will be provided. Following them helps maintain your piece and may prevent issues not covered under warranty.
    8.4. Repairs outside warranty can be quoted separately.

9. Photos, Marketing & Privacy

9.1. We may photograph completed pieces for our portfolio, website, or social media, without identifying you personally.
9.2. If you do not wish your piece to be photographed, please notify us in writing before the job is completed.
9.3. We respect your privacy and will not share your personal information without consent unless required by law.

10. Limitation of Liability

10.1. To the maximum extent permitted by law, our liability is limited to:

  • the re-supply of the goods or services, or
  • the cost of re-supplying the goods or services,
    except where the ACL requires otherwise.
    10.2. We are not liable for:
  • natural timber behaviour over time
  • delays outside our control
  • costs arising from changes in the client’s preferences or circumstances
  • damage caused by misuse, improper care, or modification by the client
    10.3. Nothing in these Terms excludes any rights you have under the ACL.

11. Acceptance of Terms

By paying your deposit or approving the quote, you confirm that you have read, understood and agree to these Terms & Conditions.
